1. Copyright Policy

Gigpeach respects intellectual property rights and expects users to do the same. It is Gigpeach's policy to respond to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act, 17 U.S.C. Section 512, and to terminate repeat infringers in appropriate circumstances.

2. Designated Agent

Gigpeach will designate a DMCA agent with the U.S. Copyright Office and publish the agent's contact information on the Service. Notices should be sent to:

3. DMCA Takedown Notice Requirements

A copyright owner or authorized agent may submit a notice containing all information required by 17 U.S.C. Section 512(c)(3), including:

A physical or electronic signature of the copyright owner or authorized agent.

Identification of the copyrighted work claimed to be infringed.

Identification of the allegedly infringing material and information reasonably sufficient for Gigpeach to locate it, such as event URL, stream URL, producer name, date, time, or screenshot.

Contact information for the complaining party.

A statement that the complaining party has a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.

A statement that the information in the notice is accurate and, under penalty of perjury, that the complaining party is authorized to act on behalf of the copyright owner.

4. Gigpeach's Response

Upon receiving a valid notice, Gigpeach may remove or disable access to the allegedly infringing material, terminate a stream, suspend an event, notify the Producer, preserve records, refund viewers, withhold payouts, or take other action. Gigpeach may reject incomplete notices.

5. Counter-Notification

A user whose material was removed may submit a counter-notification containing the information required by 17 U.S.C. Section 512(g), including:

The user's physical or electronic signature.

Identification of the material removed or disabled and the location where it appeared before removal.

A statement under penalty of perjury that the user has a good-faith belief the material was removed or disabled because of mistake or misidentification.

The user's name, address, telephone number, and email address.

Consent to jurisdiction of the federal district court for the judicial district in which the user's address is located, or if outside the United States, the federal district court serving Boise, Idaho, and agreement to accept service of process from the complaining party.

Gigpeach may restore removed material in accordance with the DMCA if the complaining party does not file an action seeking a court order within the statutory period, unless Gigpeach independently determines that the material violates law, provider rules, or Gigpeach's policies.

6. Repeat Infringer Policy

Gigpeach may terminate users who are repeat infringers. Gigpeach may consider repeated valid DMCA notices, court findings, obvious infringement, suspicious event patterns, sports rebroadcasts, unauthorized music events, repeated rights complaints, or other evidence. Gigpeach may terminate accounts immediately for serious or willful infringement.

7. Misrepresentations

Submitting false or abusive DMCA notices or counter-notices may create legal liability under 17 U.S.C. Section 512(f). Gigpeach may suspend users who abuse the DMCA process.

8. No Legal Advice

Gigpeach cannot provide legal advice regarding copyright, fair use, licensing, or counter-notices. Users should consult counsel.
